UPDATE: CMS Flexibilities to Fight COVID-19 in Long Term Care Facilities

In response to the Coronavirus (COVID-19) pandemic, the Centers for Medicare & Medicaid Services (CMS) released temporary regulatory waivers and new rules to provide the healthcare system with flexibilities.

In July 2020, CMS updated these temporary regulatory changes and updated the “Long Term Care Facilities (Skilled Nursing Facilities and/or Nursing Facilities): CMS Flexibilities to Fight COVID-19.”

Below is an update on these new changes.

Staffing Data Submission

Previously, CMS was waiving 42 CFR 483.70(q) to provide relief to long term care (LTC) facilities. By waiving this regulation, CMS wasn’t requiring facilities to submit staffing data through the Payroll Based Journal system. As of June 25, 2020, CMS reinstated the submission of staffing data through the Payroll Based Journal system.

Cost Reporting

CMS is delaying the filing deadline for certain cost report due dates. The filing deadline of the FYE 12/31/2019 cost reports were originally due by May 31, 2020 but has been extended and will now be due by August 31, 2020. The filing deadline of the FYE 1/31/2020 cost reports due date has also been extended to August 31, 2020. The filing deadline of the FYE 02/29/2020 cost reports due date has been extended to September 30, 2020.
